Star Party Rentals Rental Service Agreement
This Service Agreement (the “Agreement”) is between Star Party Rentals and the Client (individually the “Party” or “you” and collectively the “Parties” to this Agreement). Star Party Rentals is agreeable to providing such services to the Client on the terms and conditions set out in this Agreement. By receiving this Agreement, the Parties agree as follows:
1. RESERVING EQUIPMENT: Quotes and proposals do not guarantee availability of rental equipment. Equipment will be officially reserved upon a non-refundable deposit of a 50% of total charges. This deposit can be paid by cash, check or E-transfer. If after completing the reservation you need to change the date of the scheduled equipment delivery/setup, Star Party Rentals cannot guarantee all equipment will be available for the new date and will accommodate as best as possible.
2. PLEASE NOTE Star Party Rentals only setup tents and flooring. Any additional equipment including but not limited to tables, chairs, tablecloths and other requested inventory will be placed under the tent and/or delivered at the site for the Client to setup. If the Client requires Star Party Rentals to setup any additional equipment, additional fees will be applied to the final payment.
3. FINAL PAYMENT: Final payment is due at the time of the delivery or pickup. Final payment includes the other 50% of total charges and any additional fees that are added on including but not limited to delivery fees and extra setup fees. Star Party Rentals accepts cash, check and E-transfer. Additional fees such as damaged and missing equipment may be invoiced at the time of pickup.
4. CANCELLATION OF RESERVATION:
5. This equipment cannot be sub-rented or used by any other party then that listed on the given invoice.
6. MISSING AND DAMAGED EQUIPMENT: DO NOT staple, tag, pin, tape, use marker or attach anything to the equipment. The Client is responsible for all equipment from the time of delivery until pickup. If any or all equipment are not present at the scheduled pickup time, it will be considered missing. The Client will be held liable for any missing, damaged, lost or stolen equipment and will be charged a replacement cost. A detailed invoice of these items will be provided to the Client. The Client must report any existing damage to the equipment within two (2) hours of delivery time, otherwise the Client will be held liable for the damages.
7. SITE PREPARATION: Star Party Rentals will pick up the equipment on a specified date and agreed time upon delivery of the equipment. Please ensure the site is ready (i.e. lawns mowed, vehicles out of the way, etc.) before the arrival for setup. All obstacles must be removed from the site for the safety of the Client and to ensure safe installation of the tent(s). Additional time of thirty (30) minutes or more of removing obstacles and preparing the site will result in a site preparation fee that will be added to the final payment. It is the Client’s responsibility to inform Star Party Rentals of the existence of any private underground utilities (i.e. phone or gas lines, septic system, pool pipes, irrigation lines, etc.). Star Party Rentals is not responsible for any damages that may occur due to the Client’s inability to properly prepare the site beforehand and in absence of such notice of underground utilities. PLEASE NOTE possible damage to lawn or property may occur due to vehicle/trailer weight and from the stakes needed to keep the tent stabilized.
8. DELIVERY: Star Party Rentals strives to accommodate Client delivery requests. However, delays and changes in the schedule are sometimes unavoidable. Star Party Rentals will communicate any scheduling changes as they occur. All items will be delivered and picked up at the designated location. To request a specific delivery/setup time or change the delivery location, the Client must call or text 416-648-8797 at least four (4) days in advance of the reservation, otherwise Star Party Rentals will deliver/setup at the assigned time and location given on the original reservation. The client must be available to count all items upon delivery and pickup, otherwise Star Party Rentals counts will be considered accurate. Any delivery outside of the 20km radius of Star Party Rental’s head office is subject to a delivery fee that will be applied to the final payment.
9. CLEANUP AND PREPARATION FOR PICKUP: All floral arrangements, trash, food and decorations of any kind must be removed from tent(s) and equipment before scheduled pickup. All chairs and tables should be folded and stacked for efficient pickup. Failure to comply will result in cleanup fees invoiced at the time of pickup. All dishes, glassware and cooking equipment should be returned to proper rack or container. Dishes, glassware, and flatware must be well rinsed and food and particle-free. DO NOT ATTEMPT TO TAKE DOWN THE TENT(S) OR REMOVE ANY PARTS FROM THE TENT(S).
10. WEATHER: The Client understands that tents are temporary structures designed to provide limited protection from weather conditions, primarily sun and rain. In the event of harsh weather including but not limited to strong winds, lightning tornados and severe thunderstorm, please evacuate the tent to prevent any injuries and call Star Party Rentals if you have any questions or concerns. The Client understands that it is their responsibility to be aware of changing weather conditions and evacuate the tent(s) if necessary. Star Party Rentals reserves the right to take down tent(s) and remove equipment to prevent injuries and further property damage due to the harsh weather conditions. Star Party Rentals may cancel the order in the event of harsh weather and will refund the full deposit to the Client.
THE CLIENT ADHERES TO THE ABOVE TERMS AND CONDITIONS SET FORTH IN THE AGREEMENT AND INDEMIFY, DEFEND AND HOLD STAR PARTY RENTALS, ITS OWNERS AND EMPLOYEES HARMLESS FROM AND AGAINST ANY AND ALL LIABILITY AND COSTS INCURRED BY THE INDEMIFIED PARTIES IN CONNECTION WITH ANY CLAIM AARISING OUT OF ANY BREACH BY THE CLIENT OF THIS AGREEMENT OR THE HARM/DAMAGE TO THE PERSONS AND/OR PROPERTY CAUSED BY ANY EQUIPMENT.
